Testimony/Consulting/Investigations
Extti's professionals have worked on well over
400 cases as Expert Witness/Consultants. Their work is
divided between Plaintiffs and Defendants. These have
included cases for and against employers in the public
and private sectors.
In their defense
work and on investigations, Extti has been retained by
some of the best- known law firms in the country--
including by several national labor and employment law
firms. Similarly, they have been retained as Expert
Witnesses by many well-respected Plaintiff’s
firms, as well as by the EEOC.
Clearly, it would not be discreet to
list these firms on this page. However, many
Plaintiff and Defense references are available upon
request. Here are samples of some of the comments
made:
After a jury verdict in
favor of the Defense, Defense counsel wrote about Mr.
Robbins’ January 2004 testimony—
"….I’ve been singing
your praises to everyone at our firm .... Thank you so
much for being so helpful and available-- especially
when we were doing all the depo prep work and for your
trial testimony…"
Plaintiff’s counsel
wrote about Mr. Robbins’ April 2004
testimony—
One of the jurors, the young
female, … said you were plaintiff's best
witness. Clearly, you outshone [the opposing expert],
who was evasive, needed questions repeated (once
stating she was having a ‘blonde moment’),
and she came across as a hired gun, without much to
add. …. we are pleased to prevail, and credit
your assistance as being crucial to our case.
Thank you once again, and feel free
to give my name as a reference to any potential
attorney engaging your firm. It is a pleasure to work
with you.
After obtaining a favorable
jury verdict in July 2004, here is what
Plaintiff’s counsel said about Mr. Robbins’
testimony—
“You tied it all together for
the jury. It was just fabulous. Great, great
testimony….And I think you blew away everybody,
including opposing counsel. It’s quite
remarkable what you are able to do.”
Most of the jurors left at the end
of that trial. So counsel was unable to talk to the
bulk of them. But, "One juror ....called [and] thought
you were very credible and your testimony was
well-received. He said you knew the case better than
anyone in the room."
After obtaining a favorable
jury verdict in November 2004, here is what
Plaintiff’s counsel said about Mr. Robbins’
testimony—
"Thank you for your assistance and
invaluable knowledge on this case. I have referred
your contact information to two other attorneys and
will continue to do so in the future. The jury also
spoke very highly of you and said that your testimony
definitely assisted them in coming to a verdict."
After a March 2005
Deposition, Plaintiff’s counsel wrote to Mr.
Robbins—
“Again you were awesome in
your depo, I have never seen anything like that before,
in 21 years of practice. Thanks …. They might
still be in shock from your performance.”
Plaintiff’s counsel called in
about Mr. Barer's’ August 2005 trial testimony,
saying—
“Scott, you were awesome!"
After obtaining a favorable
jury verdict in February 2006, Plaintiff’s
counsel commented on the jury's reaction to Mr.
Robbins’ testimony, saying—
"The jury loved you."
After obtaining $1.5 Million
verdict in April 2006, Plaintiff’s counsel wrote
to another plaintiff's attorney about Mr. Robbins'
testimony—
"He was awesome. He was also
extremely helpful and generous with me, particularly in
helping me prep for my cross of other witnesses."
After obtaining a favorable
jury verdict in June 2006, Plaintiff’s counsel
wrote to Mr. Robbins—
"Thank you for your help. Your
testimony was crucial to the case. ...I posted on 4
listservs re: the verdict and also how crucial your
testimony was and how great you ... were at trial....
(They only asked for read back of your testimony. I
know we would have lost if we didn’t have
you)!!!"
After
obtaining a $3.9 Million verdict in February 2007,
Plaintiff’s counsel emailed Mr.
Robbins—
“Tnx a million times for
your help and support!!!... if you would like to use me
as a reference I would be very
plzd.”
Following an April 2007 trial,
Defense counsel wrote to Mr.
Robbins—
“You were
fantastic….”
Following his trial testimony
in July 2007, Plaintiff’s counsel emailed Mr.
Robbins. (Plaintiff won the case a few weeks
later)—
“You are
awesome.”
Following his deposition
testimony in December 2007, counsel emailed Mr.
Robbins—
"You
go over and beyond in being an expert! The best that I
have ever seen.... You are a real professional. Thank
you."
Following his March 2008 trial
testimony, Defense counsel wrote to Mr.
Sniderman—
“We won the trial. The jury came
back 10-2 after about 2 hours in our favor on all
counts…. I really appreciate your
professionalism and excellent
work.”
In September 2008 after obtaining a $2.2
million verdict, Plaintiff’s counsel was asked by
another attorney if he would recommend Mr. Robbins on
another case. Counsel emailed Mr. Robbins his
response--
“I gave you an excellent
recommendation. I hope you get the
gig.”
Here
is what Plaintiff’s counsel had to say in an
email to Mr. Robbins, about Ms. Balin’s November
2008 trial testimony--
“I
just wanted to let you know how fantastic Cathy was
today at trial... Cathy’s demeanor was perfect
and she gracefully weaved in facts without effort. You
guys are a tremendous team and I appreciate the work
that you do…even if sometimes you do work for
the defense!”
Here
is what Plaintiff’s counsel had to say in an
email to Mr. Robbins, following his November 2008
deposition--
“I want you to know that I
thought your depo testimony was so impressive. If you
ever need a recommendation or quote, etc. for your web
site, just let me know."
After a
December 2008 jury verdict in favor of the Plaintiff,
Defense counsel called Mr. Barer (who had
testified for the Plaintiff) to compliment him
on his testimony. He left the following voice
message--
"Scott, your testimony was the 'missing link' -- they
came back in favor of the plaintiff --
$500,000-plus.…The jurors listened to you; in
fact, they asked for your CV during deliberations. So,
you must be 'the man.'"
After a July 2009 verdict in
favor of the Plaintiff, Plaintiff’s counsel spoke
to Mr. Robbins
saying--
"You were magnificent as usual."
After an October 2009 verdict
(of $820,700)
in
favor of the Plaintiff
(a current employee of
a
public sector employer), Plaintiff’s counsel
emailed Mr. Robbins
to let him know the results--
"Verdict
in our favor on harassment and failure to prevent
harassment …. Thanks again for your help as I think it
obviously made a difference."
In November 2009,
trial counsel for Plaintiff emailed Mr. Robbins during
trial preparations:
“By the way, I saw for the
first time first hand your tremendous testifying skills
in the … deposition. I never read it before but
remember the … attorney who defended [said] you were the
best expert he had ever seen. Your clarity and
cleanness in testifying comes through very strong in the
transcript.”
In March 2010, Plaintiff's counsel emailed Mr. Robbins'
following the jury's verdict in Plaintiff's favor:
"We
won on all claims (fail to accommodate, fail to interact
and disability discrimination); verdict was $531K.
Your testimony was very effective, I think, by the way.
So I thank you for that, big time....
Nice client; good jury; strong HR expert. The winning
combo!"
